Restoration of Gun Rights

Georgia law offers two potential options for restoration of Second Amendment rights: a Retroactive First Offenders Petition and a Pardon through the State Board of Pardons and Parole.

Option 1: Retroactive First Offender

Retroactive First Offenders Petition is an alternative sentencing option that allows a person with no prior felony convictions to dispose of their criminal case without a conviction. Individuals who qualified for sentencing pursuant to this article but who were not informed of his or her eligibility for first offender treatment may be eligible to apply for Retroactive First Offenders. If granted, the conviction on your criminal record may be removed pursuant to current applicable law.

Option 2: Pardon through State Board

A Pardon through the State Board offers “official” forgiveness by a statement attached to the criminal record. This does not expunge, remove, or erase the crime from your criminal record; however, it does serve as a means for the Petitioner to advance in employment and/or education. Pardons restore civil and political rights. To apply for a pardon, the petitioner must have completed all sentence(s) at least five (5) years prior to applying; must have lived a law-abiding life during the five (5) years prior to applying; and all fines and restitution must be paid in full prior to filing.
